I'm putting this on all the forums i'm a member of..

Ok, I brought a motorcycle on ebay. Paid the seller as it was a buy it now and its not yours untill you pay.. Seller was not happy with eBay holding the money until i give the seller the 6 diget code when i go to pick the bike up. So seller told me not to come and pick the bike up. Less than an hour later the bike was back up for sale.

Open a case with both ebay and paypal. But because of the paypal case being open ebay closed there case and paid the seller the money without the code, and knowing i did not have the bike and it was relisted on ebay. Paypal then closed there case as there protection does not cover vehicles.

So now i have gone to the police. I have been told this, It could be looked at as fraud or vehicle theft as he has been paid the money for the motorcycle and not given me the motorcycle or a refund and relisted it for sale. Police coming to my home 9am friday.

I think i'm going to the papers with this once it is all sorted as i think more people need to know ebay and paypal are not foolproof.

I do know his first name and i think i've found out his last name as well. I have his address as well and it matches google earth and the other vehicle on his driveway.

So im now playing the long game.

I hope it gets resolved quickly. Is it possible for your bank to issue a chargeback against Paypal?

No, If you buy an item on your credit card and pay thought paypal with it (like a lot of people do). then its paypal and not the credit card company who deal with it.

I have just been reading my home insurance and i have Legal expenses cover.
Now reading up on it. It says the following. Cover for disputes in several areas, such as; contracts, data protection, personal injury, tax protection and VAT.
So this could be covered as it is a contract between the seller and myself.
So i will see how i get on with the police on friday and go from there.

Have you looked into filing a small claims court action. From memory you can fill it in on line for next to nothing, if you have his name and address it should be quite straightforward.

The problem is he is near Scunthorpe which is a 4 hour drive for me.

So the police have now been to see me.
I'm still not 100% sure how they are going to deal with it, if they do deal with it.
He said even though i had paid, the seller did not have the money at the time he relisted the bike for sale again on ebay. ebay had the money on hold untill i was to give the seller the 6 diget code when i picked the bike up. But ebay still gave the seller the money after 10 days.
So any case the police make would be from the date the money was released to the seller and in there account, as of that point the bike was sold and paid for in full. So from that date the bike should not have still been for sale, or i should of been refunded my money back right away.
So i'm just playing the waiting game now for the police to do there checks.

THIS - It easy for a person to ignore you, ebay and paypal and whilst they can try to ignore the court, the courts don't like people who ignore them and have some good laws to to back them up.
